MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain Mortgage date August 5, 2003, executed by Phillip E. Hornsby, (“Mortgagor”),to Regions Bank Office (“Mortgagee”), in the original principal amount of $138,450.75 and recorded August 6, 2003, in the Office of the Judge of Probate for Lee County, Alabama in Mortgage Book 3010, Page 442; said mortgage having subsequently been transferred and assigned to RREF RB ACQUISITIONS, LLC by instrument recorded in Mortgage Book 3869, Page 443, and further transferred and assigned to RREF RB SBL-AL, LLC, by instrument recorded in Mortgage Book 4123 Page 961; all recording references are in the aforesaid Probate Office; the undersigned RREF RB SBL-AL, LLC, holder of the Mortgage, as set forth above, under and by virtue of the power of sale contained in said Mortgage will sell, at public outcry to the highest bidder for cash, in front of the main entrance to the Courthouse in Lee County, Alabama on August 26, 2015, during the legal hours of sale, the following described real estate situated in Lee County, Alabama, to wit:
Lot 1, in Block “A” of the T.P. Eiland Subdivision in Section 23, Township 18 North, Range 29 East, Lee County, Alabama, as the same appears of record in Plat Book 2, at page 30, in the Office of the Judge of Probate of Lee County, Alabama.
ALSO:
Lot 2 and part of Lots 6, 7, & 8, Block “A” of the T.P. Eiland Subdivision in Section 23, Township 18 North, Range 29 East, Lee County, Alabama, according to a map or plat thereof on record in the Office of the Judge of Probate of Lee County, Alabama, in Plat Book 2, Page 30; said property being further described in a survey prepared by Fred L. Brinkley, C.E. Al. Reg. #3195 on July 12, 1976 as follows:
FROM a point where the North/South Section line of said Section 23 intersects the South margin of the Opelika Road run thence North 82°58’ West a distance of 100 feet to an iron pin at the Point of Beginning; FROM THE POINT OF BEGINNING run North 82°58’ West a distance of 100 feet to an iron; thence South 01°07’ East a distance of 300 feet to an iron; thence North 82°58’ West a distance of 100 feet to an iron; thence South 05°34’, West a distance of 600 feet to an iron; thence South 84°00’ East a distance of 376.3 feet to an iron; thence along the North/South Section line of Section 23, North 01°45’ West a distance of 600 feet to an iron, thence North 82°58’ West a distance of 100 feet to an iron; thence along the East margin of a dirt driveway North 01°07’ West a distance of 300 feet to the Point of Beginning.
Mortgagee makes no representation or warranty as to the physical condition of the real estate and/or any improvements thereon. The above described property will be sold on an “as is” basis, subject to any unpaid taxes, all reservations and restrictions contained in prior deeds and all other matters of record, including restrictive covenants and easements for road rights of way, utilities or rights of ingress and egress. Said property will be sold without representation, warranty or recourse, express or implied, as to title, condition, use and/or enjoyment of the property, and will be sold subject to the statutory right of redemption. This sale is subject to being postponed or cancelled.
