The contractor will be furnishing all labor and materials and performing all work for the
construction of:
Pickleball Courts Facility II
within the City of Opelika, Alabama. This project consists principally of the follow¬ing the construction of 12 pickleball courts. The overall asphalt area:138’ X 223’. Turnkey pricing on delivery and installation meeting all specifications on base, asphalt, fencing, nets, posts, resurfacer, colored play surfacing, and lines.
All bidders on construction projects in excess of $10,000.00 shall file with his bid either a certified check payable to the City of Opelika for an amount not less than five (5) percent of the estimated cost or of the contractor’s bid but in no event more than $10,000.00; or a bid bond payable to the City of Opelika in an amount of not less than five (5) percent of the estimated cost or of the contractor’s bid, but in no event more than $10,000.00.
All Bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered by the City official; the Bidder shall show such evidence by clearly displaying the license number on the outside of the envelope in which the bid is delivered. Also, the
contractor shall also be a Certified Tennis Court Builder as designated by the American Sports Builders Association (ASBA). The Certified Tennis Court Builder shall be an employee of the Tennis Court Contractor and shall oversee all phases of the new court construction process.
No bidder may withdraw their bid within 90 days after the opening thereof.

A copy of the proposed ordinance will be available online at www.leeco.us under Government / County Commission / Proposed Noise Ordinance and can also be reviewed in person in the Lee County Commission Office.
The purpose of the public hearings will be for interested parties to make oral and/or written comments into the public hearing record. Those wishing to make oral comments at the public hearings are also encouraged to submit those comments in writing. All comments must address the subject of the public hearing or issues that have an impact on the County Commission’s ability to meet applicable laws, rules, and regulations affecting the final decision.

AN ORDINANCE TO AMEND THE ZONING ORDINANCE AND ZONING MAP OF THE CITY OF OPELIKA
BE IT ORDAINED by the City Council (the “City Council”) of the City of Opelika, Alabama (the “City”) as follows:
Section 1. That Ordinance 124-91 entitled “Zoning Ordinance City of Opelika, Alabama”, adopted on September 17, 1991, and the Zoning Map of the City of Opelika provided for and referred to therein, as previously amended and/or modified, be and the same is hereby amended by rezoning or redistricting the parcel of land hereinafter in this section described, so as to change such parcel from one class of district to another class of district as follows, to-wit:
From a C-2, GC-P District (Office/Retail, Gateway Corridor-Primary Overlay District) to a C-3, GC-P District (General Commercial, Gateway Corridor-Primary Overlay District), the parcel of land hereinafter described:

SYNOPSIS OF ORDINANCE AMENDING THE TEXT OF THE ZONING ORDINANCE OF THE CITY OF OPELIKA, ALABAMA
NOTICE IS HEREBY GIVEN pursuant to §11-45-8(b)(2) of the Code of Alabama
(1975, as amended) that on Tuesday, November 16, 2021, the City Council of the City of Opelika, Alabama, adopted Ordinance No. 025-21 amending Ordinance No. 124-91 entitled “Zoning Ordinance of the City of Opelika”. The purpose of Ordinance No. 025-21 is to amend,
modify and supplement the text of the Zoning Ordinance (Ordinance No. 124-91) in the following respects:
1. Section 2.2 of the Zoning Ordinance is amended and supplemented by adding to
Section 2.2 the definitions of “City”, “City Council”, “Code of Ordinances”, “Fence”, “Parking Lot”, “Person”, “Planning Commission”, “Planning Director” and “Right-of- Way”. Section 2.2 is further amended by amending the definition of “Parcel”. Section 2.2 is further amended by deleting the definition of “Subdivision Identification Marker”.
2. The Zoning Ordinance is amended by deleting subsection 6.4E.
3. Section 7.3 of the Zoning Ordinance is revised so that the use category “Outdoor
Advertising” is deleted and removed from the use category matrix in Section 7.3. Also, the footnote relating to Outdoor Advertising at the end of the matrix table in Section 7.3 is deleted.
4. Subsection 7.6B(7)(c)(2) of the Zoning Ordinance is amended to remove references to drive-in features as they relate to signage.
5. Subsection 7.8H of the Zoning Ordinance is deleted.
6. Subsection 8.14(5) of the Zoning Ordinance is amended to remove signage standards specific to a home occupation.
7. Subsection 8.18.1B of the Zoning Ordinance is amended to remove signage standards specific to a planned residential development.
8. Subsection 8.18.1N is amended to remove standards for entrance signs to a
planned residential development.
9. Subsection 8.24D(5) of the Zoning Ordinance is deleted.
10. Subsection 8.26 of the Zoning Ordinance is deleted.
11. Subsection 8.27B(4) of the Zoning Ordinance is deleted.
12. Current Section IX “Sign Regulations” of the Zoning Ordinance is deleted in its
entirety and replaced with new Section IX “Sign Regulations” consisting of subsections
9.1 through 9.15.
The proposed new Section IX, “Sign Regulations”, of the Zoning Ordinance will provide for a purpose, intent and scope; provide for definitions; provide for applicability; provide for prohibited signs; provide general provisions for signs (such as measurement of sign area, measurement of sign height, façade or building unit measurements, signs in overlay districts, sign illumination for temporary and permanent signs, use of neon, electronic message signs, viewpoint and speaker neutrality, consent of legal owner of property, signs on public property, signs must maintain clearance, signs declared a nuisance and repair, signs presenting immediate peril to public health or safety, unsafe signs, street
address signs, driveway signs, flag poles and flags, flag brackets, flag stanchions and flags, freestanding signs, subdivision or development entrance signs, wall signs, drive-
through signs, umbrella signs, awning signs, canopy signs, changeable copy signs, projecting signs, window signs and door signs); provide for temporary and permanent signs allowed in zoning districts; provide for temporary signs allowed in zoning districts; provide for permanent signs allowed in zoning districts; provide for building permits; provide for sign permits; provide for nonconforming signs; provide for miscellaneous sign provisions; provide for violations and penalties; provide for removal of unlawful and dangerous signs; provide for severability; provide for repeal of conflicting ordinances or parts thereof, provide an effective date, provide for publication and provide for
codification in Zoning Ordinance.
Ordinance No. 025-21 was introduced by the City Council on November 2, 2021, and adopted on November 16, 2021. The effective date of the Ordinance is the date of publication of
this synopsis, and the provisions of said Ordinance will apply to all signs placed, erected, constructed, displayed, painted, relocated, modified, expanded, maintained, altered or installed in
every zoning district within the City of Opelika. This Ordinance will apply to all areas within the
corporate limits of the City of Opelika.
A copy of the full text of Ordinance No. 025-21 may be obtained from the office of the City Clerk at City Hall, 204 South 7 th Street, Opelika, Alabama, during normal business hours. In
addition, a copy of said Ordinance will be included on the City’s Internet website:
