NOTICE IS HEREBY GIVEN in accordance with §23-4-2, Code of Alabama, 1975, that the City Council of the City of Opelika will conduct a Public Hearing during the regularly scheduled City Council meeting on Tuesday, July 5, 2017, beginning at 7:00 p.m. in the Opelika City Council Chambers of the Municipal Building, 204 S. 7th Street, Opelika, Lee County, Alabama, to receive the benefit of public input concerning a proposal to vacate a portion of 22nd Street. All persons interested in the proposed vacation are invited to appear at the public hearing and express their views. Written statements or objections may be submitted to the City Clerk prior to the time of the hearing.
The portion of 22nd Street proposed to be vacated is more particularly described as follows:
Commencing at a concrete monument marking the southeast corner of Lot 5A, Pride of Pepperell Subdivision, Phase 1, as recorded in Plat Book 36, Page 183, in the office of the Judge of Probate of Lee County, Alabama, said monument being located at the intersection of the westerly R/W line of U. S. Highway No. 280 (Gateway Drive) and the northwesterly R/W line of 1st Avenue; thence, along said R/W line, S73°13’59”W, 678.05 feet; thence S16°43’04”E, 10.05 feet; thence S73°18’08”W, 37.82 feet to the True Point of Beginning of the Right-of-Way to be Abandoned; thence, continuing along the northwesterly R/W line of the aforementioned 1st Avenue, S73°08’30”W, 234.76 feet to the northeasterly R/W line of 24th Street; thence N16°45’48”W, along said R/W line, 5.26 feet; thence, leaving said R/W line, N67°52’13”E, 58.22 feet; thence northeasterly along a curve concave northwesterly, and having a radius of 435.00 feet, an arc length of 505.17 feet, a chord bearing of N34°36’59”E, and a chord length of 477.26 feet to an existing ½” open-top pipe on the westerly R/W line of 22nd Street; thence, along the new westerly R/W line of said street, S0°24’39”W, 92.64 feet; thence southeasterly along a curve concave northeasterly and having a radius of 480.00 feet, an arc length of 111.07 feet, a chord bearing of S6°13’06”E, and a chord length of 110.83 feet; thence, leaving said new R/W line, southwesterly along a curve concave northwesterly and having a radius of 495.00 feet, an arc length of 186.31 feet, a chord bearing of S36°30’55”W, and a chord length of 185.21 feet to the True Point of Beginning.
Said parcel of land lying and being in the southeast quarter of Section 14, Township 19 North, Range 26 East, in Opelika, Lee County, Alabama, and containing 0.44 acres, more or less.
A copy of the Petition to Vacate and the proposed resolution approving the vacation will be available upon request at the office of the City Clerk, 2nd Floor of City Hall, 204 South 7th Street, Opelika, Alabama.
