NOTICE IS HEREBY GIVEN in accordance with §23-4-2, Code of Alabama, 1975, that the City Council of the City of Opelika will conduct a Public Hearing during the regularly scheduled City Council meeting on Tuesday, August 17, 2021, beginning at 7:00 p.m. in the Courtroom of the Municipal Court Building, 300 Martin Luther King Boulevard, Opelika, Lee County, Alabama, to receive the benefit of public input concerning a proposal to vacate a portion of an unnamed street lying between Lots 5, 6 and 8A of a subdivision plat entitled “Revision of Lots 3,4, 8, 9, 10, 11, 12, 13, 14, 15 & 18, a re-subdivision of Lots 4 and 7 of Fox Run Industrial Park, First Revision First Addition”, according to and as shown on plat of said subdivision of record in Plat Book 20 at Page 89 in the Office of the Judge of Probate, Lee County, Alabama.  All persons interested in the proposed vacation are invited to appear at the public hearing and express their views.  Written statements or objections may be submitted to the City Clerk prior to the time of the hearing.

The portion of said unnamed street proposed to be vacated is more particularly described as follows:

TO:  RESIDENTS AND PROPERTY OWNERS OF THE CITY OF OPELIKA AND ALL OTHER INTERESTED CITIZENS

NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Opelika, Alabama will hold a regular meeting and will be conducting public hearings on Tuesday, August 24, 2021 at 3:00 p.m. in the Meeting Chamber at Opelika  Municipal Court located at 300 MLK Boulevard, Opelika, Alabama. A Planning Commission work session will be held at 2:30 pm before the regular meeting. The purpose of the public hearings is to receive public comment on the following:

1. A public hearing on a request by Chao Han, property owner, for preliminary plat approval of the South Lake Area Bank Parcels, Redivision of Lot 2 subdivision consisting of 5 lots accessed from the 1500 block South Uniroyal Road.  .

2a.  An agenda item related to a rezoning request concerns an amendment to the Future Land Use Map  for 166 acres at the corner of Highway 431 and Cusseta Road from a low density residential land use category to a mixed use development category. If the Planning Commission votes to send a positive recommendation to the City Council to rezone the 166 acres and Council approves the rezoning, then approval of said amendments to the Future Land Use map will be approved. 

2b.  A public hearing to consider a recommendation to the City Council on a request by Blake Rice,   authorized representative for William B. Lowe, Jr. and Mary S. Haines, property owners, to rezone 166 acres at the corner of Highway 431 and Cusseta Road from R-1 zoning district to a PUD zoning district.

2c.  A public hearing on a request by Blake Rice, authorized representative for William B. Lowe, Jr. and Mary S. Haines,  property owners, for preliminary plat approval of the Blackberry Reserve subdivision plat consisting of 245 lots accessed at the corner of Highway 431 and Cusseta Road.

3.A request by Blake Rice, authorized representative for W.S. Newell & Sons, Inc., property owner, for final plat approval of the Towne Lakes, Phase 5 subdivision consisting of 102 lots accessed from Bush Creek Road off Towne Lake Parkway.

4.A public hearing on a request by Jack Johnson, authorized representative for Opelika East, LLC, property owners, for conditional use approval for a Climate-Controlled Self-Storage building in the       C-2, GC-S zoning district accessed at the 300 block Samford Avenue.   

5.A public hearing on a request by Zami Ali, authorized representative for Deke Hilyer, property owner, for conditional use approval for a lounge in the Z&Z Cigar Shop in the C-1 zoning district at 108 South 9th Street.  

6.A public hearing on a request by Marrell McNeal, authorized representative for Family Farm Limited Partnership, property owners, for conditional use approval for an outdoor wedding and parties business  located on 81 acres in a conservation easement in a R-2 zoning district at 2500 Willis Avenue.

Section 1.  That Ordinance 124-91 entitled “Zoning Ordinance City of Opelika, Alabama”, adopted on September 17, 1991, and the Zoning Map of the City of Opelika provided for and referred to therein, as previously amended and/or modified, be and the same is hereby amended by rezoning or redistricting the parcels of land hereinafter in this section described, so as to change such parcels from one class of district to another class of district as follows, to-wit:

From a R-1 District (Rural District) to a R-3 District (Low-Density Residential District), the parcels of land hereinafter described:

Lots 1, 2, 3, 4 and 5 as shown on the “Harwell Hills Sixth Addition” subdivision plat recorded in Plat Book 43 at Page 154 on May 27, 2020, at the Lee County, Alabama Courthouse.
