ORDINANCE NO.  125-16
ORDINANCE AUTHORIZING THE CONVEYANCE OF
REAL PROPERTY TO WILLIAM HARRISON
(10962 LEE ROAD 279)
BE IT ORDAINED by the City Council of the City of Opelika, Alabama as follows:
Section 1.  It is hereby established and declared that the following described real property of the City of Opelika, Alabama, is no longer needed for public or municipal purposes, to-wit:
Lots 1 and 2 of Block B, Beulah Estates, as shown by map or plat of said subdivision recorded in Plat Book 7 at Page 114 in the Office of the Judge of Probate of Lee County, Alabama.
Said lots being further described as Tax Parcels 43-02-06-14-000-032.000 according to the records in the office of the Lee County Revenue Commissioner.
The address of the above-described property is 10962 Lee Road 0279, Cusseta, AL  36852.
Section 2.  The City of Opelika having received an offer from William Harrison to purchase the real property described in Section 1, above, it is hereby declared to be in the best interest of the public and the City of Opelika to sell said real property to William Harrison in the consideration of the sum of Five Thousand, Five Hundred Dollars ($5,500,000).
Section 3.  The Mayor is hereby authorized and directed to execute for and in the name and on behalf of the City, a sales contract, between the City of Opelika and William Harrison and the City Clerk is hereby authorized and directed to affix the seal of the City to said contract and to attest the same.  Said contract shall be substantially in the form attached as Exhibit “A” to this Ordinance, which form is hereby adopted in all respects as if set out in full in this ordinance, with such changes as may be approved by the Mayor.
Section 4.  The Mayor and the City Clerk be, and they are, authorized and directed to execute and attest, respectively, for and on behalf of the City of Opelika, Alabama, a statutory warranty deed, a copy of which is on file in the Office of the City Clerk, whereby the City of Opelika does convey the premises described in Section 1 hereof to William Harrison for and in consideration of the sum of $5,500.00, such purchase price to be satisfied as specified in the attached contract.
Section 5.  This ordinance shall become effective immediately upon its adoption and publication as required by law.
Section 6.  The City Clerk of the City of Opelika is hereby authorized and directed to cause this ordinance to be published one (1) time in a newspaper published in and of general circulation in the City of Opelika, Alabama.
Section 7.  That Ordinance Number 120-16 adopted on September 6, 2016 is hereby repealed.
