ORDINANCE NO.  101-15

AN ORDINANCE TO AMEND THE ZONING

ORDINANCE AND ZONING MAP OF THE CITY OF OPELIKA

BE IT ORDAINED by the City Council (the “City Council”) of the City of Opelika, Alabama (the “City”) as follows:

Section 1.  That Ordinance 124-91 entitled “Zoning Ordinance City of Opelika, Alabama”, adopted on September 17, 1991, and the Zoning Map of the City of Opelika provided for and referred to therein, as previously amended and/or modified, be and the same is hereby amended by rezoning or redistricting the parcel of land hereinafter in this section described, so as to change such parcel from one class of district to another class of district as follows, to-wit:

From a R-4M District (Medium Density Residential District) to a M-1 District (Industrial District) the parcel of land hereinafter described:

57.034 acres of land, more or less, in the Northwest Quarter of Section 20, Township 19 North, Range 27 East, Opelika, Lee County, Alabama, more particularly described as follows:  FROM the Northwest corner of said Section 20, run thence South 88 degrees 14 minutes East, 1,207.0 feet to the point of beginning of the property here described:  FROM SAID POINT OF BEGINNING, continue South 88 degrees 14 minutes East, 644.1 feet; thence South 89 degrees 15 minutes East, 569.7 feet; thence North 89 degrees 01 minutes East, 316.3 feet:  thence South 5 degrees 23 minutes West, 2,085.9 feet to a point on the Northeasterly margin of the Old Columbus Road in Opelika, Lee County, Alabama:  thence North 61 degrees 31 minutes West along the Northeasterly margin of said road, 1,124.2 feet; thence North 62 degrees 57 minutes West along the Northeasterly margin of said road, 272.4 feet to the Southeasterly corner of an old cemetery; thence leaving said road, run North 0 degrees 40 minutes East along the Easterly margin of said cemetery, 240.0 feet; thence North 88 degrees 14 minutes West, along the Northerly boundary of said cemetery, 120.0 feet; thence North 0 degrees 40 minutes East, 1,197.2 feet to the point of beginning, containing 57.034 acres, more or less, according to a survey of said property made for the Circuit Court of Lee County, Alabama, by James L. McCrory, dated May 30, 1984.

LESS AND EXCEPT:

PARCEL B:  Commence at the northeast corner of Section 20, Township 19 North, Range 27 East in Lee County, Alabama; thence run South 1504.26 feet; thence run West 3956.31 feet to an iron pin on the northerly margin of Old Columbus Road and the POINT OF BEGINNING; FROM SAID POINT OF BEGINNING, thence run along said margin North 64°05’37” West, 116.96 feet to an iron pin; thence run North 00°28’37” West, 277.46 feet to an iron pin; thence run South 76°59’22” East, 155.45 feet to an iron pin; thence run South 08°30’52” East, 296.82 feet to an iron pin and the POINT OF BEGINNING; containing an area of 0.862 acres, more or less according to that certain survey done by James L. McCrory dated February 07, 2005.

The above-described parcel, containing approximately 56 acres, lies along the northeasterly margin of Old Columbus Road and adjoins the current site of East Alabama Paving Company.

Section 2.  Any ordinance or part thereof in conflict with provisions of this Ordinance be and the same are hereby repealed.

Section 3.  This Ordinance shall be published in a newspaper of general circulation in the City of Opelika, Lee County, Alabama.
