BE IT ORDAINED by the City Council (the “Council”) of the City of Opelika, Alabama (the “City”) as follows:
Section 1. FINDINGS. The Council has determined and hereby finds and declares that the following facts are true and correct:
(a) Freeman JJLP (the “Owner”) is the owner of record of that certain property consist-ing of 211 acres located south of Columbus Parkway and east of Interstate 85.
(b) The Owner, by and through its authorized representative, Samford Group, LLC, heretofore submitted to the City a development plan for a planned unit development (“PUD”) con-sisting of approximately 211 acres, designated as “Bridgewater Planned Unit Development”. The proposed development is located south of Columbus Parkway and east of Interstate 85.
(c) The proposed development is a residential development consisting of approximately 541 single-family detached home lots.. The development will include a mix of 65 and 50 foot wide lots with a density of 2.60 units per acre. Amenities include a clubhouse and pool, a 2.8 acre wooded park, three (3) playgrounds, three (3) pocket parks and a two (2) mile walking trail.
(d) On June 24, 2025, the Planning Commission heretofore conducted a public hearing of the proposed development and referred to the City Council its recommendation to disapprove the proposed development.

BE IT ORDAINED by the City Council (the “Council”) of the City of Opelika, Alabama (the “City”) as follows:
Section 1. FINDINGS. The Council has determined and hereby finds and declares that the following facts are true and correct:
(a) Rebecca Walton Young and Oline Walton Price (the “Owners”) are the owners of record of that certain property consisting of 174.2 acres located on the east side of South Uniroyal Road, on the north side of Old Columbus Road, and south of Drakes Landing PUD.
(b) The Owners, by and through their authorized representative, Hayes Eiford, heretofore submitted to the City a development plan for a planned unit development (“PUD”) consisting of approximately 174.2 acres, designated as “Mayfair Planned Unit Development”.
(c) The proposed development is a residential development consisting of approximately 401 single-family home lots. The development will include a mix of 50, 60 and 70 foot wide lots. The overall density of the development is 2.3 units per acre. Approximately forty-three percent (43%) of the site (75 acres) will consist of open space, including nine (9) pocket parks.
(d) The development will be accessed from two new streets that intersect South Uniroyal Road. The southernmost entrance is across from Chewacla Road, which is the primary spine through the development.

AN ORDINANCE TO AMEND THE ZONING
ORDINANCE AND ZONING MAP OF THE CITY OF OPELIKA (THE MILL DEVELOPMENT PUD)
BE IT ORDAINED by the City Council (the “Council”) of the City of Opelika, Alabama (the “City”) as follows:
Section 1. FINDINGS. The Council has determined and hereby finds and declares that the following facts are true and correct:
(a) Opelika Mill Holdings, LLC is the owner of record of that certain property consist-ing of 39.64 acres located in the Pepperell Village Historic District and located south of 29th Street, east of Cunningham Drive and north of the railroad tracks in the corporate limits of the City.
(b) Opelika Mill Holdings, LLC, by and through its authorized representative, Holland Homes, LLC, heretofore submitted to the City a development plan for a planned unit development (“PUD”) consisting of approximately 39.64 acres, designated as “The Mill Development Planned Unit Development”.
(c) The proposed development is a mixed-use development consisting of single-family houses, townhouses, apartment buildings, offices and other commercial uses. The property is divided primarily into two sections. The commercial and multi-family area is located south of 1st Avenue. The remaining residential area is located primarily north of 1st Avenue. The residential development consists of 327 residential units, which include 24 50-foot single-family homes, 43 40-foot single-family homes, 114 townhomes and 146 multi-family/apartment units. Overall, the develop-ment will have a density of 7.98 units per acre.
(d) On March 25, 2025, the Planning Commission heretofore conducted a public hear-ing of the proposed development and referred to the City Council its recommendation to approve the proposed development.
(e) It is advisable and in the interest of the City and the public interest that the proposed property described in Section 3 below should be developed as a mixed-use planned unit development.
Section 2. APPROVAL OF THE DEVELOPMENT PLAN. The Development Plan as submitted for review is hereby approved and affirmed as required by Section 8.18(N) of the Zoning Ordinance of the City.
Section 3. DESIGNATION OF A PLANNED UNIT DEVELOPMENT. The official Zoning Map is hereby amended and the zoning classification for the following parcel of land shall be changed from a PUD (Planned Unit Development) and C-2 District (Office/Retail District) to a Planned Unit Development (PUD) on the official zoning map of the City.

WHEREAS, Rebecca Walton Young and Oline Walton Price (hereinafter referred to as the “Petitioners”) being the owners of the property hereinafter described, heretofore filed a Petition for Annexation (the “Petition”) with the City of Opelika, Alabama, a municipal corporation, a copy of which is attached hereto as Exhibit “A”, requesting the annexation of certain property owned by the Petitioners as more particularly described below; and
WHEREAS, the Petitioners are the owners of all of the lands described in their Petition; and
WHEREAS, the territory to be annexed is contiguous to the existing corporate limits of the City of Opelika and does not embrace any territory within the corporate limits of another munici-pality, and when annexed into the City of Opelika will form a homogenous part of the City; and

The City Council of the City of Opelika, finds and declares, as the legislative body of the City of Opelika, that it is in the best interest of the citizens of the City of Opelika, to bring the territory described in Section 2 of this Ordinance into the corporate limits of the City of Opelika.

WHEREAS, Uniti Fiber GulfCo, LLC (hereinafter referred to as “GulfCo”) is a fiber-optic based telecommunications company; and
WHEREAS, GulfCo designs, builds, operates and maintains fiber optic infrastructure throughout the Gulf Coast; and
WHEREAS, GulfCo desires to use the public rights-of-way in the corporate limits of the City of Opelika, Alabama (hereinafter referred to as the “City”) in order to construct its network and to provide its communications services; and
WHEREAS, the City and GulfCo have been in negotiations regarding the use of the City’s rights-of-way for the provision of fiber optic services; and
WHEREAS, the City has considered the request of GulfCo and is desirous of granting a non-exclusive right to use the City’s rights-of-way; and
WHEREAS, a proposed Rights-of-Way Use Agreement (hereinafter the “Use Agreement”) has been prepared and submitted to the City Council for approval, and the City Council has determined that it is now in the best interest of the City and its citizens to approve said Use Agreement.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Opelika, Alabama, as follows:
Section 1. That the proposed Use Agreement to be entered into between the City and GulfCo, a copy of which is attached hereto as Exhibit “A”, is hereby approved, authorized, ratified and confirmed in the form substantially submitted to the City Council with such changes thereto (by addition, deletion or substitution) as the Mayor shall approve which approval shall be conclusively evidenced by the execution and delivery of said Use Agreement.
Section 2. That GulfCo may utilize the rights-of-way in the corporate limits of the City in order to construct its fiber optic network and to provide its communications service in accordance with and subject to the terms and conditions of the Use Agreement.
Section 3. That the Mayor is hereby authorized to execute and deliver said Use Agreement in the name and on behalf of the City, and the City Clerk is hereby authorized and directed to affix the seal of the City to said Use Agreement and to attest the same.
Section 4. That the officers of the City and any person or persons designated and authorized by any officers of the City to act in the name and on behalf of the City, or any one or more of them, are authorized to do or caused to be done or performed in the name and on behalf of the City such other acts and to execute and deliver or cause to be executed and delivered in the name or on behalf of the City such other notices, certificates, assurances or other instruments or other communications under the seal or otherwise, as they, or any of them deem necessary or advisable in order to carry into the provisions of this Ordinance and the attached Use Agreement.
Section 5. That the Use Agreement shall be effective in accordance with its terms.
Section 6. That the Ordinance shall take effect immediately upon its passage, adoption and publication as required by law.
Section 7. The City Clerk is hereby directed to publish this Ordinance, including the Use Agreement, in synopsis form in a newspaper of general circulation published in the City of Opelika, Lee County, Alabama, pursuant to §11-45-8(b)(2), Code of Alabama (1975, as amended). GulfCo shall assume all publication costs with respect to the ordinance, including the Use Agreement, as such publication is required by law.

SYNOPSIS OF AN ORDINANCE WHEREBY THE CITY OF OPELIKA, ALABAMA
GRANTS TO UNITI FIBER GULFCO LLC, THE NON-EXCLUSIVE RIGHT TO USE THE RIGHTS-OF-WAY TO CONSTRUCT ITS NETWORK AND TO PROVIDE ITS COMMUNICATIONS SERVICES IN ACCORDANCE WITH AND SUBJECT TO THE TERMS AND CONDITIONS OF A RIGHT-OF-WAY USE AGREEMENT BETWEEN UNITI FIBER GULFCO LLC AND THE CITY OF OPELIKA, ALABAMA
- On September 2, 2025, the City Council for the City of Opelika, Alabama, adopted Ordinance No. 026-25, the purpose of which is to grant Uniti Fiber GulfCo LLC, a limited liability company (“GulfCo”) for a ten (10) year period from the effective date, the non-exclusive right to utilize the rights-of-way in the corporate limits of the City of Opelika, Alabama, (the “City”) in order to construct its network and to provide its communications services in accordance with and subject to the terms and conditions of the Rights-of-Way Use Agreement between Uniti Fiber GulfCo llc, and the City of Opelika, Alabama (“Use Agreement”).
- As a consequence, GulfCo is authorized, subject to the City’s police powers, including the City’s management of its rights-of-way, to construct and operate a fiber-optic network, of a not-to-exceed diameter, that is of current and modern design with a broadband capacity meeting or exceeding the capacity set by the federal government as broadband that will provide its communications services, which are defined as services, other than cable service or any other multichannel video services, which are available to customers or subscribers, either on a wholesale or retail basis, through facilities that enable the provision, whether bundled or unbundled, of voice, video, data, or advanced communications services, including telecommunications services, information and data services, and Internet services. The term also includes the lease, license, sale, or other right of use provided to other persons, including other communications services providers, of portions of the network including facilities, fiber (whether dark or lit), or capacity thereon.
- In exchange, GulfCo is to pay to the City on a quarterly basis a use fee of five percent (5%) of gross revenues consisting of any and all payments made to, compensation or consideration of any kind or nature, including cash, credits, property, and in-kind contributions (services or goods), derived or received, directly or indirectly by GulfCo, or by any affiliate, from or in connection with the operation or use of the network to provide communications service. GulfCo is also required, among other requirements, to indemnify the City, maintain insurance coverage, and post security.

BE IT ORDAINED by the City Council (the “City Council”) of the City of Opelika, Alabama (the “City”) as follows:
Section 1. Amendment of Section 2.2 of the Zoning Ordinance.
Section 2.2, “DEFINITIONS”, of Ordinance No. 124.91 entitled “Zoning Ordinance of the City of Opelika, Alabama, adopted on September 17, 1991, as further amended (hereinafter referred to as “Zoning Ordinance”) is hereby amended as follows:
- Section 2.2 is amended by amending the definitions of “Bed and Breakfast Inn” and “Hotel/Motel” to read as follows:
Bed and Breakfast Inn. A private residence or portion thereof, where short‑term lodging, rooms and meals are offered. The property owner of the inn shall live within Opelika city limits. The inn keeper or operator shall be available and on-call within the Opelika city limits at all times during any guest occupancy.
Hotel/Motel. A commercial establishment providing a private room for sleeping accommodations for a fee on a daily basis with private bathroom facilities and customary lodging services. Related ancillary uses may include, but are not limited to conference and meeting rooms, restaurants, sale of convenience items, bars, and recreational facilities.
- Section 2.2 is amended and supplemented by adding to Section 2.2 the definition of “Bed and Breakfast Operator” to read as follows:
Bed and Breakfast Operator – A person who manages the daily operation of a bed and breakfast establishment and shall be available and on-call within the Opelika city limits at all times during any guest occupancy.
Section 2. Amendment of Section 3.1. That Footnote 1 to Section 3.1 of the Zoning Ordinance, as amended, is further amended to read as follows:
1Exemptions. Temporary uses located in Temporary Structures that do not exceed 3 days in a 12-month period AND the temporary structure is 800 square feet or less in size will not require a building permit nor zoning approval. If the event is to be held at a recognized celebration site for special events, observances, days and the like, the 12-month time separation requirements between events will be waived. Celebration sites include all places of worship, country clubs, hotels, conference centers, bed and breakfast facilities, recognized places of receptions, public parks, etc.
Except as modified herein, all other subsections, paragraphs and provisions of Section 3.1 shall remain unchanged and in full force and effect.
Section 3. Amendment of Section 7.3C of the Zoning Ordinance. That Section 7.3C (“Uses”) of the Zoning Ordinance is hereby amended to read as follows:
That the use categories of “Tourist House” and “Bed and Breakfast Inn” in the pertinent portion of the matrix table be and the same is hereby amended to read as follows:

Section 4. Amendment of Section 8.11.1. That the first and second paragraphs of Section 8.11.1 entitled “Exemptions” of the Zoning Ordinance, as amended, are further amended to read as follows:
SECTION 8.11.1 TEMPORARY STRUCTURES/ TEMPORARY USES
Temporary structures and/or temporary uses are permitted only as expressly provided in this section. No temporary use or temporary structure shall be established unless a zoning permit evidencing the compliance of such use with the provisions of this section and other applicable provisions of this Ordinance shall have first been issued, as provided in Section 3.1, Building Permit Required.
Exemptions. Temporary Uses located in Temporary Structures that do not exceed three (3) days in a twelve (12) month time period and the temporary structure is eight hundred (800) square feet or less in size will not require a building permit nor a zoning approval. If the event is to be held at a recognized celebration site for special events, special observances, special functions, special days and the like, the twelve (12) month time separation requirement between events will be waived. Celebration sites include all places of worship, country clubs, hotels, conference centers, bed and breakfast facilities, recognized places of reception, public parks, etc.
Except as modified herein, all other subsections, paragraphs and provisions of Section 8.11.1 shall remain unchanged and in full force and effect.
Section 5. Amendment to Section VIII of Zoning Ordinance. That Section VIII, “GENERAL REGULATIONS”, of the Zoning Ordinance is hereby amended by adding a new subsection to be numbered 8.28.4, “BED AND BREAKFAST INNS”, which subsection shall read as follows:
SECTION 8.28.4 BED AND BREAKFAST INNS
- Purpose and Intent
The purpose and intent of this section is to regulate and provide special standards for the uses of single-family homes for bed and breakfast inns. This special residential use allows short-term lodging and meals in a private residence where the use and operation of the bed and breakfast maintains the character of the surrounding neighborhood. For the purposes of determining signage and landscaping, this shall be considered a residential use.
- Use Standards
- Location – Guest lodging shall be restricted to the principal dwelling unit only; guest rooms shall not be in any accessory structures.
- Operational Requirements
- Bed and Breakfast uses shall only be permitted for owner-operated or manager-operated dwelling units, the operator shall reside within Opelika city limits. The Innkeeper/Operator shall be available and on-call within the city limits at all times during any guest occupancy.
- Breakfast shall be offered daily to guest and the cost of such service shall be included in the overall lodging rate.
- The maximum number of guest rooms shall be limited in accordance with building and fire safety codes as determined by the Opelika Building Inspection Department and Opelika Fire Department.
- The number of guest rooms shall be noted at the time of application for use approval. The number of guest rooms shall not be increased without going through the same approval process.
- The maximum stay for any guest shall be 29 days.
- No guest rooms shall contain their own cooking facilities.
- The operation of the facility shall be in character with the adjoining residential properties. Lighting, parking, and waste collection shall be handled in similar methods to the adjacent properties. The applicant shall provide a plan and/or narrative that shall describe how these issues will be addressed. Additional landscaping, fencing, or screening may be required through the conditional use process or by the Planning Director for locations where the use is allowed.
- The use shall be in compliance with all federal, state, and local laws, including, but not limited to all building, fire and life safety codes, and environmental health regulations for the level of occupancy of the lodging.
- Parking – The use shall be required to provide one (1) on-site parking space per guest room in addition to the required parking for the residential use requirement. No parking shall be located within a front yard. All parking shall be screened from the public right-of-way and adjoining residential properties. On street parking shall not be allowed to meet the required amount of parking for the primary or any accessory uses.
- Bed and Breakfast uses shall only be allowed in structures that are at least seventy-five (75) years old or older.
- Guest Registry – The owner shall maintain a reservation book or a registration log. The book or log shall show the arrival and departure dates of the primary guest and shall be open for inspection by a City of Opelika Code Enforcement Officer.
- The minimum age to register or book a room as the primary guest shall be 19. Children under 19 years of age must be accompanied by at least one adult.
- Additional requirements for Private Events:
- The minimum age to register or book a room as the primary guest shall be 19. Children under 19 years of age must be accompanied by at least one adult.
- Private events at a Bed and Breakfast Inn in a residential zone are subject to the maximum attendees, times, and durations described below:
- Maximum number of attendees (including overnight guests) for indoor events shall be limited in accordance with the building and fire safety codes and regulations as determined by the Opelika Fire Department and/or Opelika Building Inspection Department.
- A maximum of ten (10) outdoor private events are allowed per year. The minimum lot size to host outdoor private events is one (1) acre. Private outdoor events shall be limited to properties that abut a roadway classified as an arterial, major collector, or minor collector by the City of Opelika.
- The maximum number of guests for an outdoor private event shall be 200, unless further restricted by other limiting factors including parking, building, fire, or life safety regulations.
- Parking for private events shall be one (1) parking space per three (3) guests. All parking for private events shall be identified either on site or through written agreement with an adjoining nonresidential use. No on-street parking shall be counted towards the required parking for private parties or events.
- Hours of operation for private events are limited to between 7:00 a.m. and 11 p.m.
- Landscaping/Buffering/Screening. Outdoor private event areas adjacent to single family residential uses shall install a 10 foot buffer to include an opaque wood and/or masonry fence not less than six (6) feet in height, with horizontal or vertical openings not greater than three (3) inches per one (1) linear foot AND a four (4) foot wide strip of evergreen plantings, which will grow to at least six (6) feet in height within two full growing seasons planted on the inside of the fence. This buffer may be modified upon written agreement by the affected adjoining residential property.
- No outdoor private event shall be allowed without approval of a temporary event permit.
- No amplified sound shall be allowed after 10 p.m. All events shall be required to meet the noise standards in effect at the time of the event.
- All electrical connections and temporary structures shall be inspected and approved by the Building Inspection Department as required by adopted building codes.
- Permit Application. An application for a temporary private event permit shall be made to the Planning Director at least forty-five (45) days before the event.
- An application for a temporary event permit shall not be processed and shall be summarily denied if ten (10) events have already occurred at the location in question during the calendar year.
- The applicant shall submit a site plan specifying the location of all tents, temporary structures, equipment, performance area and/or the location of any outdoor service or activity to be performed. Any structure or activity shall not occupy required parking spaces, nor interfere with driveway aisles, ingress and egress, sight triangles, or required buffer yards.
- Requirements for Approval. The Planning Director shall approve an application for a temporary event permit if:
- The application limitation discussed in Section 8.28.4 C.2. of this section has not been exceeded;
- There is no pending code enforcement action on the property underlying the proposed event location;
- An access and parking plan has been approved;
- A fire protection and life safety plan has been approved by the Fire Chief;
- Adequate temporary or permanent sanitary facilities are provided.
- Appeals. An applicant or any interested person may appeal the decision of the Planning Director to the City Council within ten (10) days of the date of the decision. The appeal shall be made on the forms provided by the Planning Department. Upon receipt of a completed appeal form, the Planning Director shall forward the matter for hearing before the City Council not less than five nor more than thirty (30) days thereafter and shall give written notice of the hearing to the appellant. The City Council shall render its decision within thirty (30) days following the close of the appeal hearing.
Section 6. Severability. If any section, clause, provision or portion of this Ordinance shall be held to be invalid or unconstitutional by any court of competent jurisdiction, said holding shall not effect any other section, clause, provision or portion of this Ordinance which is not in or of itself invalid or unconstitutional.
Section 7. Repeal of Conflicting Ordinances. Any ordinance or part thereof in conflict with provisions of this Ordinance be and the same is hereby repealed. All sections, subsections, paragraphs, sentences, clauses and remaining portions of the Zoning Ordinance shall remain in full force and effect, save and except as amended by this Ordinance.
Section 8. Effective Date. This Ordinance shall become effective upon its adoption, approval and publication as required by law.
Section 9. Publication. This Ordinance shall be published in a newspaper of general circulation in the City of Opelika, Lee County, Alabama.

Section 1. Amendment of Section 2.2 of the Zoning Ordinance.
Section 2.2, “DEFINITIONS”, OF Ordinance No. 124.91 entitled “Zoning Ordinance of the City of Opelika, Alabama, adopted on September 17, 1991, as further amended (hereinafter referred to as “Zoning Ordinance”) is amended by amending the definitions of “Bed and Breakfast Inn” and “Hotel/Motel” to read as follows:
Bed and Breakfast Inn. A private residence or portion thereof, where short‑term lodging, rooms and breakfast are offered. The property owner of the residence shall live on the premises. The owner shall be available and on-call within Lee County at all times during any guest occupancy.
Hotel/Motel. A commercial establishment providing a private room for sleeping accommodations for a fee on a daily basis with private bathroom facilities and customary lodging services. Related ancillary uses may include, but are not limited to conference and meeting rooms, restaurants, sale of convenience items, bars, and recreational facilities.
Section 2. Amendment of Section 3.1. That Footnote 1 to Section 3.1 of the Zoning Ordinance, as amended, is further amended to read as follows:
1Exemptions. Temporary uses located in Temporary Structures that do not exceed 3 days in a 12-month period AND the temporary structure is 800 square feet or less in size will not require a building permit nor a zoning approval. If the event is to be held at a recognized celebration site for special events, observances, days and the like, the 12-month time separation requirements between events will be waived. Celebration sites include all places of worship, country clubs, hotels, conference centers, bed and breakfast facilities in non-residential zones, recognized places of receptions, and public parks.
Except as modified herein, all other subsections, paragraphs and provisions of Section 3.1 shall remain unchanged and in full force and effect.
Section 3. Amendment of Section 7.3C of the Zoning Ordinance. That Section 7.3C (“Uses”) of the Zoning Ordinance is hereby amended to read as follows:
That the use categories of “Tourist Home” and “Bed and Breakfast Inn” in the pertinent portion of the matrix table be and the same is hereby amended to read as follows:

Section 4. Amendment of Section 8.11.1. That the first and second paragraphs of Section 8.11.1 entitled “Exemptions” of the Zoning Ordinance, as amended, are further amended to read as follows:
SECTION 8.11.1 TEMPORARY STRUCTURES/ TEMPORARY USES
Temporary structures and/or temporary uses are permitted only as expressly provided in this section. No temporary use or temporary structure shall be established unless a zoning permit evidencing the compliance of such use with the provisions of this section and other applicable provisions of this Ordinance shall have first been issued, as provided in Section 3.1, Building Permit Required.

Temporary Uses located in Temporary Structures that do not exceed three (3) days in a twelve (12) month time period and the temporary structure is eight hundred (800) square feet or less in size will not require a building permit nor a zoning approval. If the event is to be held at a recognized celebration site for special events, special observances, special functions, special days and the like, the twelve (12) month time separation requirement between events will be waived. Celebration sites include all places of worship, country clubs, hotels, conference centers, bed and breakfast facilities in non-residential zones, recognized places of reception, and public parks.
Except as modified herein, all other subsections, paragraphs and provisions of Section 8.11.1 shall remain unchanged and in full force and effect.
Section 5. Amendment to Section VIII of Zoning Ordinance. That Section VIII, “GENERAL REGULATIONS”, of the Zoning Ordinance is hereby amended by adding a new subsection to be numbered 8.28.4, “BED AND BREAKFAST INNS”, which subsection shall read as follows:
SECTION 8.28.4 BED AND BREAKFAST INNS
- Purpose and Intent
The purpose and intent of this section is to regulate and provide special standards for the uses of single-family homes for bed and breakfast inns. This special residential use allows short-term lodging and breakfast in a private residence where the use and operation of the bed and breakfast maintains the character of the surrounding neighborhood. For the purposes of determining signage and landscaping, this shall be considered a residential use.
- Use Standards
- Location – Guest lodging shall be restricted to the principal dwelling unit only; guest rooms shall not be in any accessory structures.
- Operational Requirements
- Bed and Breakfast uses shall only be permitted for owner occupied residential units. The owner shall be available and on-call within Lee County at all times during any guest occupancy.
- Breakfast shall be offered daily to guest and the cost of such service shall be included in the overall lodging rate.
- The maximum number of guest rooms shall be limited from one (1) to six (6) bedrooms and in accordance with building and fire safety codes as determined by the Opelika Building Inspection Department and Opelika Fire Department.
- The number of guest rooms shall be noted at the time of application for use approval. The number of guest rooms shall not be increased without going through the same approval process.
- The maximum stay for any guest shall be 29 days.
- No guest rooms shall contain their own cooking facilities.
- The operation of the facility shall be in character with the adjoining residential properties. Lighting, parking, and waste collection shall be handled in similar methods to the adjacent properties. The applicant shall provide a plan and/or narrative that shall describe how these issues will be addressed. Additional landscaping, fencing, or screening may be required through the conditional use process or by the Planning Director for locations where the use is allowed.
- The use shall be in compliance with all federal, state, and local laws, including, but not limited to all building, fire and life safety codes, and environmental health regulations for the level of occupancy of the lodging.
- Parking – The use shall be required to provide one (1) on-site parking space per guest room in addition to the required parking for the residential use requirement. No parking shall be located within a front yard. All parking shall be screened from the public right-of-way and adjoining residential properties. On street parking shall not be allowed to meet the required amount of parking for the primary or any accessory uses.
- Guest Registry – The owner shall maintain a reservation book or a registration log. The book or log shall show the arrival and departure dates of the primary guest and shall be open for inspection by a City of Opelika Code Enforcement Officer.
- The minimum age to register or book a room as the primary guest shall be 19. Children under 19 years of age must be accompanied by at least one adult.

- Accessory Uses – No other commercial use of the property shall be allowed unless permitted within the zoning district.
- The primary function of a Bed and Breakfast Inn in a residential district shall be the provision of temporary accommodations and meals to travelers, and the owner shall not use the structures, property or premises to host events, gatherings or parties for commercial gain. Commercial events, such as weddings, parties or business meetings, are considered separate uses that require different zoning classification or permit. A Bed and Breakfast Inn in a residential district may be used in the same manner as similarly situated residences to host the owner’s private events and gatherings, subject to applicable ordinances, limitations and regulations.
- Bed and Breakfast Inns in non-residential zoning districts may host events, gatherings, or other commercial events in compliance with the temporary use standards in Section 8.11.1.
Section 6. Severability. If any section, clause, provision or portion of this Ordinance shall be held to be invalid or unconstitutional by any court of competent jurisdiction, said holding shall not effect any other section, clause, provision or portion of this Ordinance which is not in or of itself invalid or unconstitutional.
Section 7. Repeal of Conflicting Ordinances. Any ordinance or part thereof in conflict with provisions of this Ordinance be and the same is hereby repealed. All sections, subsections, paragraphs, sentences, clauses and remaining portions of the Zoning Ordinance shall remain in full force and effect, save and except as amended by this Ordinance.
Section 8. Effective Date. This Ordinance shall become effective upon its adoption, approval and publication as required by law.
Section 9. Publication. This Ordinance shall be published in a newspaper of general circulation in the City of Opelika, Lee County, Alabama.
