SYNOPSIS OF ZONING NOTICE

The City Council of the City of Opelika will hold a public hearing on Tuesday, April 5, 2016, at 7:00 p.m. in the City Council Chambers of the Municipal Building, 204 S. 7th Street, Opelika, Lee County, Alabama, to consider the adoption of an ordinance to amend the Zoning Ordinance and the Zoning Map of the City of Opelika by rezoning or redistricting the parcels of land hereinafter described so as to change such parcels from one class of district to another class of district, as follows:

From a C-2 District (Office/Retail District) to a C-1 District (Downtown Commercial District), the parcels of land hereinafter described:

PARCEL 1

Commencing at the intersection of the Southwest margin of South Tenth Street with the Southeast margin of Avenue B, run thence South 45 degrees, 00 minutes West, a distance of 300 feet to the point of beginning of the property herein to be described and conveyed.  From said last mentioned beginning point, run South 45 degrees, 00 minutes East, a distance of 101.0 feet; run thence North 45 degrees, 00 minutes East, for a distance of 100.0 feet; run thence South 45 degrees, 00 minutes East, for a distance of 299.0 feet to a point on the Northwesterly margin of Avenue C; run thence South 45 degrees, 00 minutes West, along the Northwesterly margin of Avenue C, a distance of 393.3 feet to a point on the Northeasterly margin of the right-of-way of the Central of Georgia Railway Company, which point is 8 feet from the center line of a spur track of said railroad; run thence North 42 degrees, 01 minutes West, along the Northeasterly margin of said railroad right-of-way, a distance of 201.2 feet; run thence North 47 degrees, 57 minutes East, a distance of 30.7 feet; run thence North 43 degrees, 00 minutes West, a distance of 200.8 feet to a point on the Southeasterly margin of Avenue B; run thence North 45 degrees, 00 minutes East, a distance of 245.6 feet to the point of beginning.  The above described parcel is further described as 1015 Avenue B (Fire Station 1) and 1010 Avenue C (formerly developed as the old Opelika Service Building).

PARCEL 2

Commencing at the Northwest corner of the Northeast quarter of Section 18, Township 19 North, Range 27 East in the City of Opelika, Lee County, Alabama, thence run South 45.4 feet; thence run East, 106.3 feet to a point on the Southeasterly margin of Avenue C, which point is the point of beginning of the real estate here to be described and conveyed; from said point of beginning thence run North 47 degrees 36 minutes East, along and with the said Southeasterly margin of Avenue C, 84.5 feet; thence run North 88 degrees 23 minutes East, along and with the Southerly margin of an alley, 303.4 feet to a point on the Southwesterly margin of Tenth Street, 10.0 feet; thence run South 26 degrees 01 minutes West, along and with the Northwesterly margin of an alley, 629.4 feet to a point on the Northeasterly margin of the right-of-way of the Central of Georgia Railroad; thence run North 39 degrees 29 minutes West along and with the said Northeasterly margin of the right-of-way of the Central of Georgia Railroad, 229.3 feet; thence run North 25 degrees 28 minutes East, 223.6 feet; thence run North 41 degrees 59 minutes West, 43.9 feet; thence run North 26 degrees 03 minutes East, 55.1 feet; thence run North 41 degrees 32 minutes West, 62.3 feet to a point on the said Southeasterly margin of Avenue C and the point of beginning; together with all buildings and improvements thereon and appurtenances thereunto appertaining; and being situated in Sections 7 and 18, Township 19 North, Range 27 East, in the City of Opelika, Lee County, Alabama. The above described parcel is further described as 405 South 10th Street.

Public Notice of this public hearing with insertion of the proposed ordinance was first published on March 4th, 2016 in the Opelika Observer. This notice is given pursuant to Section 11-52-78 Code of Alabama (1975).
