SYNOPSIS OF AN ORDINANCE WHEREBY THE CITY OF OPELIKA, ALABAMA, GRANTS TO SPIRE ALABAMA, INC.,
THE NON-EXCLUSIVE RIGHT TO USE THE RIGHTS-OF-WAY TO CONSTRUCT, ERECT, INSTALL, RENEW, REPAIR, MAINTAIN AND OPERATE A PLANT OR SYSTEM FOR THE MANUFACTURE AND/OR DISTRIBUTION AND/OR SALE OF NATURAL GAS SUBJECT TO THE TERMS AND CONDITIONS OF THE ORDINANCE

  1. On April 7, 2020, the City Council of the City of Opelika, Alabama, adopted Ordinance No. 009-20, the purpose of which is to grant to Spire Alabama, Inc., an Alabama corporation (“Spire-A) for a thirty (30) year period from the effective date, the non-exclusive right to utilize the rights-of-way in the corporate limits of the City of Opelika, Alabama (the “City”) in order to construct, erect, install, renew, repair, maintain and operate a plant or system for the manufacture and/or distribution and/or sale of natural gas in accordance with and subject
    to the terms and conditions of the ordinance.
  2. As compensation for the use of the public ways and rights-of-way, Spire-A is to pay to the City a franchise fee equal to one percent (1%) of its gross annual revenues for each calendar year so long as the ordinance shall be effective. Spire-A is also required, among other requirements, to indemnify the City and maintain certain types of insurance coverage.
  3. A copy of Ordinance No. 009-20 may be obtained from the Office of the City Clerk of the City of Opelika, Alabama, during normal business hours.
