ORDINANCE NO.
015-21

ORDINANCE AUTHORIZING THE EXCHANGE OF

REAL PROPERTIES BETWEEN THE CITY OF OPELIKA AND CJCF, LLC

BE IT ORDAINED by the City Council of the City of Opelika (herein called the “City Council”) as follows:

Section 1.  The City Council has determined and hereby finds and declares the following facts are true and correct:

                (a)  The City of Opelika, Alabama, a municipal corporation (hereinafter called the “City”), is the owner of the land and premises described in Exhibit “A” attached and made a part hereof (all of such property being hereinafter referred to as Parcel “A”).

                (b)  CJCF, LLC, an Alabama limited liability company (hereinafter called “CJCF”), is the owner of the land and premises described in Exhibit “B” attached hereto and made a part hereof (all of such real property being referred to as Parcel “B”). 

(c)  The City desires to exchange Parcel “B” for Parcel “A”.

                (d)  Parcel “A” is no longer needed for public or municipal purposes.

(e)  It is necessary, advisable and in the interest of the City and in the public interest that the City make said exchange of real properties.

Section 2.  In exchange for the conveyance by CJCF to the City of the property described in Parcel “B”, the Mayor is hereby authorized and directed to execute and attest, respectively, for and on behalf of the City, a Statutory Warranty Deed, a copy of which is on file in the office of the City Clerk, whereby the City does convey to CJCF the land and premises described as Parcel “A”.

Section 3.  The officers of the City and any person or persons designated and authorized by any officers of the City to act in the name and on behalf of the City, or any one or more of them, are authorized to do or cause to be done or performed in the name and on behalf of the City such other acts and to execute and deliver or cause to be executed and delivered in the name and on behalf of the City such other notices, certificates, assurances or other instruments or other communications under the seal of the City or otherwise, as they or any of them deem necessary or advisable or appropriate in order to carry into effect the intent of the provisions of this Ordinance.

Section 4.  This Ordinance shall become effective upon its passage, approval, adoption and publication as required by law.

Section 5.   The City Clerk of the City of Opelika is hereby authorized and directed to cause this Ordinance to be published one (1) time in a newspaper of general circulation published in the City of Opelika, Lee County, Alabama.

SYNOPSIS OF ZONING NOTICE

The City Council of the City of Opelika will hold a public hearing on Tuesday, September 7, 2021, at 7:00 p.m. in the Courtroom of the Opelika Municipal Court Building, 300 Martin Luther King Boulevard, Opelika, Lee County, Alabama, to consider the adoption of an ordinance to amend the Zoning Ordinance and the Zoning Map of the City of Opelika by rezoning or redistricting the parcels of land hereinafter described so as to change such parcels from one class of district to another class of district, as follows:

From a R-1 District (Rural District) to a R-3 District (Low-Density Residential District), the parcels of land hereinafter described:

Lots 1, 2, 3, 4 and 5 as shown on the “Harwell Hills Sixth Addition” subdivision plat recorded in Plat Book 43 at Page 154 on May 27, 2020, at the Lee County, Alabama Courthouse.

The above-described property contains 1.26 acres, more or less, and is located in the 500 block of Rustic Street, Opelika, Alabama.

Public Notice of this public hearing with insertion of the proposed ordinance was first published on August 12, 2021, in the Opelika Observer.  This notice is given pursuant to Section 11-52-78 Code of Alabama (1975).

 All interested persons are invited to attend the public hearing and be heard. Written comments concerning the above matter may be mailed to the City Clerk at P.O. Box 390, Opelika, AL 36803 at any time prior to the public hearing and may be further submitted to the City Council at the meeting and the public hearing.
