ORDINANCE NO.  110-14

AN ORDINANCE TO AMEND THE TEXT OF THE

ZONING ORDINANCE OF THE CITY OF OPELIKA

BE IT ORDAINED by the City Council (the “City Council”) of the City of Opelika, Alabama (the “City”) as follows:

Section 1.  Amendment.  That Ordinance No. 124-91 entitled “Zoning Ordinance of the City of Opelika, Alabama”, adopted on September 17, 1991, is further amended in the following respect:

That Section 2.2 DEFINITIONS is further amended by amending the definitions of ‘Liquor” and “Package Liquor Store” to read:

LIQUOR— Any alcoholic, spiritous, vinous, fermented or other alcoholic beverage or combination of liquors and mixed liquor, a part of which is spiritous, vinous, fermented, or otherwise alcoholic and all drinks are drinkable liquids, preparations or mixtures intended for beverage purposes, which contain one-half of one percent or more of alcohol by volume, except beer and table wine.

PACKAGE LIQUOR STORE— An establishment licensed by the City where liquor is authorized to be sold in unopened containers for off premise consumption.  The definition of package liquor store also includes any licensed club or lounge licensed by the Alabama Alcoholic Beverage Control Board to sell and disburse liquor in unopened containers for off premise consumption.  The definition shall also include liquor stores operated by the Alabama Alcoholic Beverage Control Board where alcoholic beverages are authorized to be sold in unopened containers.  The definition does not include a business selling only beer and/or wine for off premise consumption.

Section 2.  Repeal of Conflicting Ordinances.  Any ordinance or part thereof in conflict with provisions of this Ordinance be and the same are hereby repealed.

Section 3.  Effective Date.  This Ordinance shall become effective upon its adoption, approval and publication as required by law.

Section 4.  Publication.  This Ordinance shall be published in a newspaper of general circulation in the City of Opelika, Lee County, Alabama.
