ORDINANCE NO. 106-15
ORDINANCE CHANGING THE NAME OF THE SOLID WASTE DIVISION OF THE CITY OF OPELIKA TO OPELIKA ENVIRONMENTAL SERVICES
WHEREAS, the Solid Waste Division is an unincorporated division of the City of
Opelika created to provide solid waste disposal services; and
WHEREAS, the City Council desires to change the name of the Solid Waste Division to Opelika Environmental Services.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Opelika, Alabama, as follows:
Section 1. Name Change. That the name “Solid Waste Division” is hereby changed to “Opelika Environmental Services”.
Section 2. Administrative Supervision by Mayor. That the Mayor and his designees shall exercise administrative supervision and control over the operations of Opelika Environmental Services.
Section 3. References in City Code. That references to “Solid Waste Division” or similar terms throughout the Code of Ordinances of the City of Opelika shall be changed to and shall mean “Opelika Environmental Services”.
Section 4. Severability Clause. If any clause, sentence or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said section shall not affect any other section, clause or provision of this ordinance which is not in or of itself invalid or unconstitutional.
Section 5. Conflict. All ordinances or parts thereof which are in conflict with the provisions of this ordinance are hereby repealed.
Section 6. Effective Date. This ordinance shall become effective upon its passage and publication as required by law.
Section 7. Publication. The City Clerk of the City of Opelika, Alabama is hereby authorized and directed to cause this ordinance to be published one (1) time in a newspaper of general circulation published in the City of Opelika, Lee County, Alabama.
