NOTICE OF MORTGAGE FORECLOSURE

WHEREAS, default has been made in the terms of the mortgage executed on the 25th day of March, 1998, by Scott Simmons and Maria Vongphrachanh, as mortgagors in favor of Freddie and Louise Coleman, husband and wife, collectively, as mortgagee, as recorded in the Office of the Judge of Probate of Lee County, Alabama, in Mortgage Book No. 2621, at Page No. 394, and said default continuing, the  mortgagee, under power of sale contained in said mortgage will sell at auction for cash to the highest bidder on the steps of the Lee County Courthouse in Opelika, Alabama on Monday, the 26th day of September, 2016, during the legal hours of sale, the following described real estate embraced in said mortgage, situated in Lee County, Alabama, to-wit:

Commencing at the Northeast corner of Section 3, Township 17 North, Range 27 East, St. Stephens Baseline and Meridian, Lee County, Alabama; run thence South 00° 00′ 00″ East for 484.34 feet to a point; run thence North 90° 00′ 00″ West for 961.12 feet to a point marked by an iron pin found on the Southerly margin or right-of-way of Lee Road 40 (formerly Lee County Highway 10); run thence South 59° 27′ 09″ West for 889.94 feet to a point marked by an iron set on said margin; run thence South 05° 59′ 08″ East for 697.56 feet to a point marked by an iron pin; run thence South 68° 38′ 31″ West for 99.53 feet to a point marked by an iron pin and the POINT OF BEGINNING of the parcel of land to be herein described and conveyed: From said point of beginning, run thence South 10° 47′ 56″ East for 147.41 feet to a point marked by an iron pin set; run thence South 68° 38′ 31″ West for 135.11 feet to a point marked by an iron pin set located on the Easterly margin of Lee Road 125; run thence North 35° 53° 03″ West for 60.04 feet along Lee Road 125 to a point marked by an iron pin set; run thence North 10° 47′ 56″ West for 88.29 feet to a point marked by an iron pin set and the POINT OF BEGINNING. Containing 0.5183 acres± according to Survey for Freddie Coleman dated 3/11/97 prepared by Walter Pryor White, Ala. Reg. Land Surveyor No. 12504.

Said sale is made for the purpose of foreclosing of said mortgage, paying the mortgage debt, the costs and expenses of foreclosure, including a reasonable attorney’s fee.

Mortgagee reserves the right to bid on the subject property.  Said mortgage is a first mortgage and is not junior to another mortgage of record. Said sale is also subject to unpaid taxes or assessments whether of record or not.
