NOTICE OF MORTGAGE FORECLOSURE SALE – 9/12/14, 9/19/14 & 9/26/14



Default having been made in the payment of that certain promissory note dated the 11th day of October, 2002, and the terms of that certain mortgage executed by JUSTIN BAILEY and wife, SHERRY R. BAILEY, to FRONTIER NATIONAL BANK, which mortgage was recorded in Mortgage Book 2907, Page 570,  in the Office of the Judge of Probate of Lee County, Alabama, the undersigned  HERITAGEBANK OF THE SOUTH, successor in interest to FRONTIER NATIONAL BANK, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the Courthouse door of the Lee  County Courthouse in Opelika, Alabama, on October 1, 2014, during the legal hours of sale, the following real estate, situated in Lee County, Alabama, to wit:

Commencing at the Northwest corner of the Southwest quarter of Section 10, Township 18 North, Range 27 East, Lee County, Alabama; thence S 00º 31’ 00” W for 1,811.1 feet to a point on the Southerly margin of a paved County Road and the Point of Beginning of the property herein conveyed.  FROM SAID POINT OF BEGINNING, run S 51º 05’ 28” E along the Southerly margin of said paved road for 304.49 feet to a point; thence S 36º 51’ 51” W for 76.55 feet to a point; thence S 16º 42’ 46” W for 152.87 feet to a point; thence S 45º 00’ 05” E for 102.19 feet to a point; thence S 42º 00’ 00” W for 349.73 feet; thence N 01º 09’ 09” E for 731.21 feet to the point of beginning.  Containing 3.2 acres.  Said property has the address of 8800 Lee Road 146, Opelika, Alabama 36804, and is shown as Parcel No. 43-17-02-10-0-000-027 on the Lee County, Alabama Tax Maps.

The indebtedness secured by said mortgage has been and is hereby declared due because of default under the terms of said promissory note, and any renewal or extension thereof, and the mortgage, including but not limited to the nonpayment of the indebtedness as and when due.  The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including a reasonable attorney’s fee, and all other payments provided for under the terms of the promissory note and mortgage.
