MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain Mortgage date August 7, 2006, executed by Phillip E. Hornsby, (“Mortgagor”),to Regions Bank Office (“Mortgagee”), in the original principal amount of $97,000.00 and recorded August 23, 2006, in the Office of the Judge of Probate for Lee County, Alabama in Mortgage Vol. 3366, Page 971; said mortgage having subsequently been transferred and assigned to RREF RB ACQUISITIONS, LLC by instrument recorded in Mortgage Book 3869, Page 447, and further transferred and assigned to RREF RB SBL-AL, LLC, by instrument recorded in Mortgage Book 4123 Page 964; all recording references are in the aforesaid Probate Office; the undersigned RREF RB SBL-AL, LLC, holder of the Mortgage, as set forth above, under and by virtue of the power of sale contained in said Mortgage will sell, at public outcry to the highest bidder for cash, in front of the main entrance to the Courthouse in Lee County, Alabama on August 26, 2015, during the legal hours of sale, the following described real estate situated in Lee County, Alabama, to wit:
Lots 1 and 2, Block “C”, according to a revised plat of Jackson Acres Subdivision. A map and plat of said revised plat of Jackson Acres Subdivision being of record in the office of the Judge of Probate of Lee County, Alabama in Plat Vo. 6, page 7, situated, lying and being in Lee County, Alabama.
Mortgagee makes no representation or warranty as to the physical condition of the real estate and/or any improvements thereon. The above described property will be sold on an “as is” basis, subject to any unpaid taxes, all reservations and restrictions contained in prior deeds and all other matters of record, including restrictive covenants and easements for road rights of way, utilities or rights of ingress and egress. Said property will be sold without representation, warranty or recourse, express or implied, as to title, condition, use and/or enjoyment of the property, and will be sold subject to the statutory right of redemption. This sale is subject to being postponed or cancelled.
