Default having been made in the payment of the indebtedness described in and secured by that certain Mortgage executed by RODNEY G. HAMRICK, a single man, to COMMUNITY BANK & TRUST, n/k/a COMMUNITY BANK & TRUST – WEST GEORGIA, dated February 22, 2007 and recorded in Mortgage Book 3423, Page 804, et seq. of the Probate Court Records of Lee County, Alabama; which Mortgage was modified by Mortgage Modification Agreement dated March 18, 2008 and recorded in Mortgage Book 3612, Page 786; which Mortgage was modified by Modification of Mortgage dated April 1, 2009 and recorded in Mortgage Book 3641, Page 248; and which Mortgage was further modified by Modification of Mortgage dated May 19, 2011 and recorded in Mortgage Book 3806, Page 699 of said Probate Court records; and the undersigned holder of said Mortgage having declared the entire indebtedness due and payable in accordance with the terms and conditions of said Mortgage, notice is hereby given that the undersigned, under and by virtue of the powers contained in said Mortgage, will sell at public outcry for cash to the highest bidder during the legal hours of sale on the 12th day of December, 2014, in front of the front or main door of the Courthouse of Lee County Alabama, in Opelika, Alabama, the following described real property lying and being situated in the County of Lee, State of Alabama, to-wit:
Lots 6 and 7, Corrective Plat Lee Road 252 Southwestern Estates, according to and as shown by map or plat of said subdivision of record in Plat Book 29, Page 101, in the Office of the Judge of Probate of Lee County, Alabama.
Said sale is made for the purpose of paying the indebtedness secured by said Mortgage and all charges as provided therein and the expense incident thereto, including a reasonable attorney’s fee.
The property may be offered for sale as separate parcels. Said property will be sold on an “as is, where is” basis subject to any easements, encumbrances, and exceptions contained in said mortgage and those contained in the records of the Office of the Judge of Probate where the above-described property is situated. Said property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment, and will be sold subject to the right of redemption of all parties entitled thereto.
