ORDINANCE NO.  132-16
AN ORDINANCE AMENDING THE BUSINESS LICENSE CODE OF THE CITY OF OPELIKA, ALABAMA BY AMENDING SECTIONS 14-326 AND 14-327 OF THE CODE OF ORDINANCES OF THE CITY OF OPELIKA
BE IT ORDAINED by the City Council (the “Council”) of the City of Opelika, Alabama (the “City”) as follows:
Section 1.  Amendment to Section 14-326 of the Code of Ordinances.  That Section 14-326 of the Code of Ordinances–CLASSIFICATION OF BUSINESSES; TAX RATES—as amended, be and is further amended in the following respect:
(a)    That NAICS Sub-Sector 8128, General Services—Manicurist is hereby amended to read as follows:
8128    General Services -Manicurist    GS
(b) That NAICS Sub-Sector 485320—Limousine Services is hereby amended to read as follows:
485320    Limousine Services
Before a license can be issued, applicant must meet all regulations and prerequisites of all City of Opelika ordinances pertaining thereunto.    GS
(c) That NAICS Sub-Sector 4921 Services/Delivery Services (local) is hereby deleted.
(d) That Section 141-326 is further amended to add the following NAICS Sub-Sector 48599—Other Transit; Ground Passage Transportation as follows:
485994921    Other Transit; Ground Passenger Transportation
Before a license can be issued, applicant must meet all regulations and prerequisites of all City of Opelika ordinances pertaining thereunto. General Services – Delivery Services (local)    GS
(e)    That NAICS Sub-Sector 48511—Miscellaneous Taxicab Company is amended to read as follows:
48511    Miscellaneous – Taxicabs; Pedicabs    MS
(f) Except as specifically amended or changed above, all other classifications, NAICS Sectors and Sub-Sectors shall remain in full force and effect.
Section 2. Amendment to Section 14-327 of the Code of Ordinances.  That Section 14-327 of the Code of Ordinances, as amended, be and is further amended in the following respect:
(a)  That Schedule 48511—Taxicab Company is amended to read as follows:

11 Taxicab and Pedicab
Company
All Taxicab and Pedicab company licenses are $100.00 plus $30.00
for each taxi vehicle and pedicab.
Before a license can be issued, applicant must meet all regulations and prerequisites of all City of Opelika ordinances pertaining thereunto
(b)      Except as specifically amended or changed above, all of the schedules of license fees as shown in Section 14-327 shall remain in full force and effect.
Section 3.Non Repealer Clause.  Nothing in this ordinance shall be construed to repeal or amend any other portion of Article XII of Chapter 14 of the Code of Ordinances, except as expressly provided herein.
Section 4. Severability Clause.  If any section, subsection, clause, sentence, phrase or word of this ordinance is declared or judged to be invalid or unconstitutional such declaration or adjudication shall not affect the remaining portions of this ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this ordinance.
Section 5.    Effective Date.  This ordinance shall become effective upon its passage and publication as required by law.
Section 6.  Publication.  The City Clerk of the City of Opelika, Alabama is hereby authorized and directed to cause this ordinance to be published one (1) time in a newspaper of general circulation published in the City of Opelika, Lee County, Alabama.
