ForeSite Services, LLC is proposing to install a lattice telecommunications tower off of County Road 138 in Opelika, Lee County, Alabama 36804 at latitude 32° 31’ 35.6” north and longitude 85° 17’ 9.4” west.  The height of the tower will be 94.5 meters above ground level (270.2 meters above mean sea level).  The tower is anticipated to have steady red lights, FAA Style E (L-864/L-865-/L-810).  Specific information regarding the project is available by calling Henry Fisher during normal business hours at (205) 629-3868.  Any interested party may submit comments by December 27, 2013 with Environmental Engineers, Inc. at 1345 Blair Farms Road, Odenville, AL 35120 for comments on the impact of the proposed action on any districts, sites, buildings, structures, or objects significant in American history, archaeology, engineering, or culture that are listed or determined eligible for listing in the National Register of Historic Places under National Historic Preservation Act Section 106.  Interested persons may review the application for this project at www.fcc.gov/asr/applications by entering Antenna Structure Registration (Form 854) file no. A0864258.  Interested persons may raise environmental concerns about the project under the National Environmental Policy Act rules of the Federal Communications Commission, 47 CFR § 1.1307, by notifying the FCC of the specific reasons that the action may have a significant impact on the quality of the human environment.  Requests for Environmental Review must be filed within 30 days of the date that notice of the project is published on the FCC’s website and may only raise environmental concerns.  The FCC strongly encourages interested parties to file Requests for Environmental Review online at www.fcc.gov/asr/environmentalrequest, but they may be filed with a paper copy by mailing the Request to FCC Requests for Environmental Review, Attn: Ramon Williams, 445 12th Street SW, Washington, DC 20554.  A copy of the Request should be provided to Environmental Engineers, Inc. at 1345 Blair Farms Road, Odenville, Alabama 35120.

Section 1.   That Section 5.7-11 of the Code of Ordinances of the City of Opelika is hereby amended to read as follows:

The following schedule of charges shall apply to all cemetery lots located in Evergreen Cemetery:

Charges for residents of Opelika:

Grave spaces: $750.00 per grave space.

Columbaria spaces: $750.00 per space.

Charges for nonresidents of Opelika:

Grave spaces: $1,500.00 per grave space.

Columbaria spaces: $1,500.00 per space.

Grave Opening and closing costs (residents and nonresidents):

Monday through Friday (before 4:00 p.m.): $450.00

Monday through Friday (after 4:00 p.m.): $550.00

Weekends: $550.00

By virtue of a writ of execution dated the 23rd day of January, 2013 directed and delivered to me as Sheriff of the County of Lee and issued out of the Circuit Court of Lee County, Alabama on a judgment rendered in such Court on Court Action Number  CV2009-900306 on May 8, 2012 in favor of DONALD H. SYNOPSIS OF ZONING NOTICE

The City Council of the City of Opelika will hold a public hearing on Tuesday, December 17, 2013, at 7:00 p.m. in the City Council Chambers of the Municipal Building, 204 S. 7th Street, Opelika, Lee County, Alabama, to consider the adoption of an ordinance to amend the Development Plan for Cannon Gate PUD.  The applicant, LCR Partners, LLC, has heretofore submitted to the City Council a proposed amended Development Plan for Lots A-1-2 and A-1-3 of Cannon Gate Subdivision.  The amended Development Plan for said lots A-1-2 and A-1-3 provides for the division of said lots into six (6) single family lots for single family detached residences.  The current Development Plan as approved by the City Council provides for the construction of two (2) triplex units on said lots.

Public Notice of this public hearing with insertion of the proposed ordinance was first published on November 15th , 2013 in the Opelika Observer.  This notice is given pursuant to Section 11-52-78 Code of Alabama (1975).
