SYNOPSIS OF ZONING NOTICE

The City Council of the City of Opelika will hold a public hearing on Tuesday, June 17, 2014, at 7:00 p.m. in the City Council Chambers of the Municipal Building, 204 S. 7th Street, Opelika, Lee County, Alabama, to consider the adoption of an ordinance to amend Ordinance No. 124-91 (entitled “Zoning Ordinance of the City of Opelika”) in the following respects:

(a)  That Section 7.6 is amended to:

(1) Delete, repeal and eliminate the categories entitled “Gateway Corridor 1 Overlay District” (GC1) and “Gateway Corridor 2 Overlay District (GC2) and substitute a new category for said districts entitled “Gateway Corridor District” (GC).

(2)  Designate the following road segments as the “Gateway Corridors” on the zoning map:

Lafayette Parkway (Highway 431) – from Cusseta Road to Lee Road 172 – north area

Lake Condy Road – from Lafayette Parkway to Andrews Road

Andrews Road – from Lake Condy Road to West Point Parkway (Highway 29) – northeast area

West Point Parkway (Highway 29) – From North Uniroyal Road to Andrews Road – northeast area

Columbus Parkway (Highway 280 East) – from the 2700 block of Columbus Parkway to Lee Road 158 – east area     Society Hill Road – from Gateway Drive to the Opelika City Limits

Frederick Road – from Gateway Drive to the 2500 block of Frederick Road – south area

Gateway Drive – from Frederick Road to Interstate Drive – south area

Highway 280 West – from west of Lee Road 072 to Veterans Parkway

Second Avenue—from intersection of East Thomason Circle and Pepperell Parkway to intersection of Plum Avenue and Second Avenue.

(3)  The boundary depth of the Gateway Corridor Overlay District shall be 600 feet measured from the street centerline of the designated Corridor except for a portion of Second Avenue.  If any portion of a lot is located within the Gateway Corridor Overlay District then the entire lot is considered within the district.

(4)  The Gateway Corridor Overlay District regulations shall apply to any parcel of land within the corporate limits of the City when a portion of said parcel falls within the Gateway Corridor except the regulations shall not apply to platted subdivision lots for new single family detached dwellings and existing single family detached dwellings.

(b)  That the District Regulations in the matrix tables in Section 7.3A are revised by eliminating references to GC-1 and GC-2 and substituting a new category entitled “GC (Gateway Corridor).  Section 7.3A is amended to adopt regulations for the Gateway Corridor District (GC).

Except as specifically amended or changed herein, all other district regulations as shown in the matrix table shall remain in full force and effect.

Public Notice of this public hearing with insertion of the proposed ordinance was first published on May 16, 2014 in the Opelika Observer.  This notice is given pursuant to Section 11-52-78 Code of Alabama (1975).
